Assembly members yesterday approved, and returned to the Senate for final vote, a proposed first-in-the-nation crackdown on unethical efforts that promise to change a person’s sexual orientation.
As written, SB 1172 would prohibit children under 18 from undergoing sexual orientation-change efforts.
The bill’s sponsor, State Senator Ted W. Lieu, D-Torrance (who will represent West Hollywood during the one-year interregnum between senate representatives caused by redistricting, and if re-elected, as the city’s senator in 2014), said about his measure, “It’s heartening to see the majority of the Assembly agrees that this kind of so-called ‘treatment’ essentially is psychological abuse of children.”
He characterized reparative therapy designed to change a youth’s sexual orientation as “quackery” and said even the movement’s foremost supporter had retreated from supporting the treatments.
“Even the person who brought any legitimacy to this kind of psychological technique, Dr. Robert Spitzer, renounced his study and apologized to the LGBT community… professionals agree that this quackery needs to stop,” he said.
Dr. Spitzer, the psychiatrist who published a controversial 2001 study proclaiming that "highly motivated" gay and lesbian people could change their sexual orientation, retracted those initial claims in April, while addressing several of the ample criticisms against its findings.
"In retrospect, I have to admit I think the critiques are largely correct," said the 80-year-old Spitzer, who is now retired and suffering from Parkinson's disease, told American Prospect earlier this year.
“The findings can be considered evidence for what those who have undergone ex-gay therapy say about it, but nothing more,” he said.
Ryan Kendall, whose parents subjected him to "ex-gay" treatments by a licensed California therapist as a teenager, testified about his experiences during the 2010 Perry v. Brown legal challenge to Prop 8, the state's voter-approved ban on same-sex marriage.
He noted that the experience, "destroyed my life and tore apart my family," in an email statement via the National Center for Lesbian Rights in San Francisco.
The Senate, which had approved an earlier version of the bill last May, must concur on amendments no later than midnight Friday.
Assembly member John Perez, the first openly gay speaker of the California's lower house, said during floor debate that "it is inappropriate for anyone, including parents, to subject anybody to dehumanizing activity," referring to the therapy.
The 51-21 vote in the Democratic-controlled Assembly marked a major victory for gay rights advocates who say the so-called conversion therapy has no medical basis because homosexuality is not a disorder.
Republican opponents of the measure said politicians should not step in and regulate what they consider to be a matter for medical boards to decide.
They also said the bill encroaches on the rights of parents to make choices for their children.
"That's why parents have children -- to hand down their legacies, their belief systems, the way they want their children raised," Assembly member Shannon Grove, a Republican from Bakersfield, said during the floor debate.
The bill now goes to Governor Jerry Brown for a signature.
