On Tom of Finland & Rainbow Stripes, an open letter from S. J. Harker, resident of West Hollywood

Dear Mayor, Mayor Pro Tem and City Councilmembers,

By your responses during your comments at tonight's City Council meeting, I can only assume you did not fully understand what I, and several other citizens, were trying to convey.

I thought I made it clear that I am not opposed to the topic of the late Tom of Finland Foundation's Erotic Art Fair.

What is art and what is pornography will probably always be debated in the public and in the courts.

In addition, yes, Abbe, I am well aware that the Tom of Finland Erotic Art Fair had been held in Plummer Park for three years, and for the past four years it has been held in West Hollywood Park, the preferred location of the event organizers, so I am told.

I am also aware that last year, 2011, there was a prominent controversy over the fact that your Arts and Cultural Affairs Commissioners "refused to put their seal of approval on the event.”

[Editor: The vote was unanimous against after “two female heterosexual members decried the event as "in bad taste" and the city park an inappropriate place to hold it because it also hosts families and children,” statements they later claimed were taken out of context.]

I am also aware that you, Ms. Land and you, John Heilman, were at the same time embroiled in controversy about trying to "de-gay" West Hollywood.

None of that is my point. I care not a feather nor a fig about the content of the "art" fair.

What I do care about is equal treatment of all 501(c) 3 nonprofit organizations.

One of the City's criteria to grant free use of Public Park facilities is that the organizations’ address is officially in West Hollywood, and Tom of Finland Foundation, as far as I know, is registered at an address in Los Angeles.

I may be mistaken… but if they are a nonprofit and receiving free rent are  they allowed to be charging at the door?

This is a commercial enterprise that will not only charge at the door but they will be selling merchandise and alcoholic beverages at the three day event.

There are many nonprofits that would love to be granted the same "co-sponsorship" free rental fees and the permission to sell beer and wine.

Is the City prepared to co-sponsor and give all nonprofits the same special dispensation as Tom of Finland Foundation of Los Angeles?

How do we pick and choose which groups to co-sponsor and which groups to charge rental fees?

Shouldn't there be equal rules for all? And if I am not mistaken, one of the representatives from Tom's intimated that next time the City would have to pay them to appear here.

Will we be paying all esoteric groups to come and do business here?

Keep in mind a nonprofit organization merely means the corporation does not make money, not that the organization and its employees do not make money.

My other topic, the $80,000 (in toto) wasteful and extravagant painted crosswalks that are barely seen.

You seem to have drifted off when I suggested that the money might be used in a more visible manner that will make a statement that people can see without the necessity for constant maintenance, such as more flags around the city or rainbow-striped power poles or a rainbow arch over Boystown... something truly creative, that will not be covered with skid marks and garbage, as they are at the moment and will be on a daily basis, needing constant cleaning.

It seems lately that more and more items that could use serious public discussion appear on the Council’s Consent Calendar.

Let's have a genuine and open public dialogue about these issues before the voting starts?
