West Hollywood’s AOL publication, Patch, is reporting that Jerome Nash is taking needed steps to demolish historic El Mirador apartments rather than accommodate WeHo’s land use ordinances.
Mr. Nash has a history of using threats and intimidation to get his way dating back to his first apartment building, given to him by his mother when he was 17.
At the time he called tenants paying rent there “ingrates” and threatened to tear down that building so he could earn the money he felt due him.
The affair led to the “Ellis Act,” which has been used by landlords around the state to chip away at tenant protections since.

He used the Ellis Act to vacate El Mirador of its last remaining tenants who maintained rent-controlled apartments for 20-42 years, calling one of them, “just one more leech that is going to be evicted from my building."
According to the AOL publication, Mr. Nash intends to tear down the building – protected from demolition by a city Cultural Resource designation – by year’s end.
The council denied the request to build condos or an urban inn inside the historic property without prejudice, meaning he can return with a plan more suitable to the council – preferably one that combines condos and an urban inn in one proposal.
The big stumbling block for Mr. Nash was parking – to sell his condos at market rate would take far more parking than the property can accommodate and installing an urban inn would require using neighborhood street parking in one of the most parking-scarce neighborhoods in town.
His decision to demolish rather than return to negotiations goes against the grain of a city conscious of its historic buildings.
According to the newly-approved General Plan 2035, “The City of West Hollywood’s Cultural Preservation Ordinance provides a high level of protection to designated cultural resources.
“Designation under the West Hollywood Cultural Heritage Preservation Ordinance offers the strongest protection. Buildings may only be demolished if their preservation will result in economic hardship for the owner.”
AOL reports that Mr. Nash said, “the only way I can get my money out of it is to tear the building down. I’ll take it as a casualty loss.”
The mercurial mega-wealthy apartment owner (Mr. Nash owns either part of or in full 200 apartment buildings) says he has collected the applications necessary to demolish the building and wants to bypass channels (the West Hollywood Historic Preservation Commission) to take his case directly to court.
How he reconciles a jam packed court case-load with such cases waiting sometimes years before they get a hearing with his target of demolition before 2013 remains unclear.
According to the City Attorney, Mike Jenkins, the matter of adaptive reuse for the property will again appear on the council agenda in August, leading observers to suggest that Mr. Nash’s plans to demolish are bluster and bluff made in an effort to get his way.
