"[Taking it down] will be very expensive, we don't know how expensive, but expensive," said Nick Thacker, general counsel for Tower Records. "That's why we had hoped to prevail; we don't think that we should pay for someone else's mistake."
The company initially got approval from the Planning Commission to erect a "creative" sign to promote its stores, products and concerts. Months later they submitted changed plans making the sign an LED display to city urban designer John Chase. Rather than refer the request for review by the Planning Commission, Mr. Chase signed off on design changes that allowed the LED display.
His error was discovered only in April once the sign was operational. The City has acknowledged that Mr. Chase erred, but countered then that any illegal signage must still come down. Susan Healy Keene, director of the Community Development Department, said that mistakes had been made by both sides. "They submitted two sets of plans and built neither one," she said.

The sometimes startlingly bright images and hot-white flashes of light emanating from the sign drew the ire of the neighbors from the start. People in offices across Sunset complained of inability to concentrate do to the often strobe-like effects. Neighbors for blocks around complained of sleeplessness caused by it. Within months, the sign began to be blamed for car wrecks and city officials additionally characterized it as a public nuisance.
The City condemned the sign as illegal and a public nuisance and Tower sued to keep it.
Michael Jenkins, West Hollywood's City Attorney, told WeHoNews.com that he was glad that the judge agreed that the sign was a nuisance and that he had also addressed the issue of Mr. Chase's mistake. "He said it didn't matter because the law had to be followed."
Mr. Thacker said that Tower had not yet determined whether or not they would appeal, but said he and the company still "firmly believe that the permit called for a 20 ft x 30 ft LED sign and that we had approval for it."
Considering the legal bills and possible demolition cost, this sign might well cost Tower Records upwards of $1 million, making it the costliest ever to be erected - and nearly immediately demolished - on the Strip.
